POLICY

It is the policy of Texas State Technical College-Harlingen to maintain control of inventoried property to prevent loss due to theft or other means and to dispose of surplus or salvage property in accordance with state laws.

PERTINENT INFORMATION

Chapter 2175 of the Texas Government Code was amended by several bills during the 76th Legislative Session affecting disposal of surplus property. Institutions of higher education must allow for the transfer of its data processing equipment to Texas Corrections Industries (TCI), Texas Department of Criminal Justice at no cost. Secondly, if TCI does not want the data processing equipment, institutions of higher education must allow for the transfer of instructional material or equipment to public schools or public school districts before disposing of the property in another manner.

DELEGATION OF AUTHORITY

Each college president has the authority and responsibility to establish college procedures to ensure compliance with this System Operating Standard.

OPERATING REQUIREMENTS

Each TSTC department must forward property or equipment to Central Receiving. Central Receiving will hold surplus property. Any department may request surplus property to be transferred to its department. If surplus property is on the State Property Accounting (SPA) System, the property must be transferred from the previous TSTC department account to the current department account. An instructional department may, by written request, obtain equipment for cannibalization of parts. The department must return unused parts to Central Receiving. The cannibalized equipment returned to Central Receiving should follow the same procedures for disposal as other surplus property.

If the college determines the property or equipment to be surplus property, the college should provide a list of surplus property to the campus presidents at the other TSTC colleges for possible transfer.

The college must allow for the transfer of its data processing equipment to Texas Correctional Industries (TCI), Texas Department of Criminal Justice, for no cost. The attached Texas Correctional Industries Wynee Computer Recovery Operating form must be completed and faxed to TCI. Each college will list the equipment as follows: type of equipment and manufacturer, model number and serial number. TCI will contact the college and determine a pick-up time for the data processing equipment. TCI will inform the college if equipment is not accepted. If the data processing equipment is accepted by TCI, Texas State Technical College will remove all information stored on the data processing equipment and box or securely wrap all equipment to be transferred. The college will notify TCI if the stored information was not removed from the data processing equipment. When TCI picks up data processing equipment, the college is responsible for loading equipment onto TCI trucks. Any equipment received by TCI that is not on the list, TCI will return and transportation costs will be billed to the college. Once the equipment is picked up by TCI, the college will remove equipment from State Property Inventory .

Next, the college will notify public schools of any surplus instructional material or equipment through THECB Surplus Higher-Ed Instructional Property website. The website information should describe the item listed, the basic condition, and the proposed sales price for the item. Low-performing and low taxable wealth per student districts will be given first preference. If the public school acquires any of the surplus equipment, the property manager will delete the property from State Property Accounting. Both the college and the receiving public school must complete a Certificate of Acquisition by Political Subdivision form.

The college will determine if all remaining equipment is not economical to repair or store. The college will request approval from the Board of Regents through a minute order to sell all excess property by auction or bid. After Board of Regents approval, the college will sell listed property. Any property remaining on state property inventory will be removed. The college will book funds received to Designated Funds surplus property account. The college must buy capital equipment from this account. However, all funds obtained from sale of airplanes from Air Pilot Training Program will be kept separately to purchase new airplanes.

PERFORMANCE INDICATORS

  1. Each college has established appropriate procedures for disposal of surplus property in compliance with state laws.
  2. Each college has properly notified the public school districts and Texas Department of Criminal Justice of available surplus property.
  3. Each college has properly accounted for the funds received through the sale of surplus property.
