The Media Center adheres to the provisions of the US copyright law and will not intentionally violate any provisions of it.

The US copyright law aims to protect the copyright owner from infringement and possible lose of income. Fair Use guidelines were developed to assist instructors and staff in determining when information can be used without permission and when permission of the author/creator must be sought.

Most items of an educational nature are protected by copyright law, including books, magazines, photographs, software, video tapes, audio tapes, CD-ROMs, sheet music, compositions, or anything published or performed, such as a play. The copyright law does permit certain items to be copied for educational use, provided certain Fair Use provisions are met.

Fair Use

As educators, you can use copyrighted materials under the FAIR USE provision. Four criteria must be met to determine if the materials you intend to use fall under the Fair Use provision.

  1. Purpose and character of the use, including whether such use is of a commercial nature or is for nonprofit educational purposes.
  2. The nature of the copyrighted work.
  3. The amount and substantiality of the portion used in relation to the copyrighted work as a whole.
  4. The effect of the use upon the potential market for or value of the copyrighted work.
