WHAT IS FERPA? The Family Educational Rights and Privacy Act of 1974, (FERPA) is a federal law that pertains to the release of and access to educational records. The law, also known as the Buckley Amendment, applies to all schools that receive funds under an applicable program of the US Department of Education. Under the FERPA Act, a student has four primary rights: v The right to inspect and review the education records within 45 days from the date request is received. v The right to request amendment to records or append a statement to the record. v The right to consent to disclosure of records. v The right to file a complaint with the FERPA Office in Washington, D.C. concerning alleged failures by an institution to comply with FERPA regulations.
